1. Introduction
This Privacy Policy describes how Genk Capital Pte Ltd (UEN 201027286K) ("Company," "we," "us," or "our") collects, uses, discloses, and protects your personal data in accordance with the Personal Data Protection Act 2012 (PDPA) of Singapore.
By accessing or using our website at genkcapital.com, including all subdomains (such as join.genkcapital.com), and any related services, platforms, or applications operated by the Company (collectively, the "Site"), or by submitting personal data through any recruitment or assessment process operated by the Company, you consent to the collection, use, and disclosure of your personal data as described in this Privacy Policy and our Terms of Use.
2. Data We Collect
Personal Data
We may collect personal data that you voluntarily provide to us, including your name, email address, and any information submitted through recruitment applications, assessment processes, or enquiry forms.
Usage Data
We automatically collect certain information when you access the Site, including your device's IP address, browser type and version, pages visited, time and date of visit, time spent on pages, and other diagnostic data.
Cookies
We use cookies and similar tracking technologies to operate and improve our Site. You may configure your browser to refuse cookies, though this may limit certain functionality.
3. Purpose of Collection
We collect and use your personal data for the following purposes: to operate, maintain, and improve the Site; to process and evaluate recruitment applications and assessments; to respond to legitimate enquiries; to detect and prevent technical issues or misuse; and to comply with applicable laws and regulations.
We will not use your personal data for purposes other than those for which it was collected without your consent, unless permitted or required by law.
4. Disclosure
We do not sell, rent, or trade your personal data. We may disclose your personal data to service providers who assist us in operating the Site, subject to appropriate confidentiality obligations. We may also disclose your personal data where required by law, regulation, or court order, or where necessary to protect our legal rights.
5. Recruitment Data
Personal data submitted through any recruitment or assessment process — including application forms, assessment responses, and evaluation results — is collected solely for the purpose of evaluating candidates. This data is retained for a reasonable period following the conclusion of the recruitment process and is then securely disposed of, unless a longer retention period is required by law or you have consented to future consideration.
Recruitment data, assessment materials, methods, and results are the Company's intellectual property. Refer to our Terms of Use for further detail.
6. Data Retention
We retain personal data only for as long as necessary to fulfil the purpose for which it was collected, or as required by applicable law. When personal data is no longer needed, it is securely deleted or anonymised.
7. Data Security
We implement commercially reasonable security measures to protect your personal data against unauthorised access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.
8. Your Rights
Under the PDPA, you have the right to request access to and correction of your personal data held by us. To make such a request, please contact the Data Protection Officer at enquiry@genkcapital.com. We will respond to your request within a reasonable time. The Company may refuse requests that are unreasonable, repetitive, frivolous, or where compliance would compromise the privacy of others.
For the avoidance of doubt, the right of access under the PDPA applies to personal data as defined under that Act. Internal evaluative opinions, assessments, scores, and recommendations formed by or on behalf of the Company for the purpose of making recruitment or hiring decisions do not constitute personal data subject to access requests. The Company is not obliged to disclose such evaluative material.
You may withdraw your consent to the collection, use, or disclosure of your personal data at any time by contacting us. Please note that withdrawal of consent may affect our ability to provide certain services or continue with a recruitment process.
9. Cross-Border Transfers
Your personal data may be transferred to and processed in jurisdictions outside Singapore where data protection laws may differ. Where such transfers occur, we will take reasonable steps to ensure that your personal data receives a standard of protection comparable to that provided under the PDPA.
10. Children
The Site is not directed at individuals under the age of 18. We do not knowingly collect personal data from minors. If you become aware that a minor has provided us with personal data, please contact us and we will take steps to remove such information.
11. Changes to This Policy
We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site following any changes constitutes your acceptance of the revised Privacy Policy.
12. Data Protection Officer
For any questions, requests, or concerns regarding this Privacy Policy or our data protection practices, please contact the Data Protection Officer at enquiry@genkcapital.com.
13. Governing Law & Jurisdiction
This Privacy Policy and any dispute arising out of or in connection with it shall be governed by and construed in accordance with the laws of Singapore. The Company is incorporated in Singapore and its data protection obligations are determined solely by the laws of Singapore, including the Personal Data Protection Act 2012 and its subsidiary legislation. The Company does not submit to the jurisdiction of any foreign data protection authority or regime. Any dispute relating to this Privacy Policy or the Company's handling of personal data shall be subject to the exclusive jurisdiction of the courts of Singapore.
