1. Agreement to Terms

These Terms of Use constitute a legally binding agreement between you and Genk Capital Pte Ltd ("Company," "we," "us," or "our"), concerning your access to and use of the website at genkcapital.com, including all subdomains (such as join.genkcapital.com), and any related services, platforms, applications, media forms, or media channels operated by the Company (collectively, the "Site"). By accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. If you do not agree with these Terms of Use, you must discontinue use immediately.

We reserve the right to make changes or modifications to these Terms of Use at any time. We will alert you about any changes by updating the "Last updated" date. You will be subject to, and will be deemed to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.

2. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws of Singapore, international copyright laws, and international conventions.

These Terms shall be governed by and defined following the laws of Singapore. You irrevocably consent that the courts of Singapore shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

8. Dispute Resolution

You agree to irrevocably submit all disputes related to these Terms or the relationship established by this Agreement to the jurisdiction of Singapore's courts.

9. Disclaimer

The Site is provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Site and your use thereof, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranties or representations about the accuracy or completeness of the Site's content.

10. Limitations of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site, even if we have been advised of the possibility of such damages.

11. Recruitment & Assessment

All recruitment processes, assessments, and evaluation criteria operated by the Company are proprietary and confidential. Hiring decisions are final and are not subject to appeal, review, or correspondence. The Company is under no obligation to provide feedback, scores, reasons, or further explanation regarding any recruitment outcome.

By participating in any recruitment or assessment process, you acknowledge that the materials, methods, and results are the Company's intellectual property and may not be reproduced, shared, or disclosed. Any attempt to harass, pressure, or otherwise contact the Company or its employees regarding a recruitment decision may result in the individual being permanently barred from future consideration.

12. Personal Data Protection

By accessing or using the Site, or by submitting personal data through any recruitment or assessment process operated by the Company, you consent to the collection, use, and disclosure of your personal data in accordance with this section and the Company's Privacy Policy.

Genk Capital Pte Ltd collects, uses, and discloses personal data in accordance with the Personal Data Protection Act 2012 (PDPA) of Singapore. Personal data submitted through this Site, including recruitment applications, is collected for the purposes for which it was provided and will not be used for unrelated purposes without your consent.

The Company retains personal data only for as long as necessary to fulfil the purpose of collection, or as required by law. You may request access to or correction of your personal data by contacting the Data Protection Officer at enquiry@genkcapital.com. The Company may refuse requests that are unreasonable, repetitive, or where providing access would compromise the privacy of others. For the avoidance of doubt, internal evaluative opinions, assessments, scores, and recommendations formed by or on behalf of the Company for the purpose of making recruitment or hiring decisions are not personal data subject to access requests under the PDPA.

13. Unsolicited Communications

Genk Capital does not accept unsolicited proposals, business plans, partnership offers, investment pitches, or service offerings. Any materials sent without prior written request may be discarded without response, review, or obligation. No communication or correspondence with Genk Capital shall be construed as creating a business relationship, partnership, or advisory engagement unless formalised by a written agreement signed by an authorised representative of the Company.
